1. Key definitions

• “Platform” refers to the Mujtahid website, mobile applications, APIs, and related services.
• “User” or “you” refers to any person or entity accessing or using the Platform.
• “Learner” refers to users who purchase or consume educational content or services.
• “Instructor” / “Expert” / “Service Provider” refers to users who offer courses, consultations, or services to Learners.
• “Mujtahid”, “we”, “us”, or “our” refers to Mojtahid Platform for Educational Services.
• “Content” refers to courses, books, materials, media, text, images, audio, video, live sessions, and other information provided on or through the Platform.

2. Eligibility and accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to open an account, unless you have verifiable parental or guardian consent.
• You agree to provide accurate, complete, and up-to-date information during registration and keep it updated.
• Each user is responsible for the confidentiality of their login credentials and for all activities under their account.
• You must notify Mujtahid immediately of unauthorized use or security breaches.
• We reserve the right to suspend or terminate accounts for violations of these Terms or applicable laws.

3. Acceptable use

You agree not to:

• Use the Platform for unlawful, fraudulent, or deceptive activities.
• Upload, post, or transmit content that is defamatory, infringing, obscene, hateful, or violates intellectual property or privacy rights.
• Attempt to bypass security controls, probe vulnerabilities, or interfere with the Platform’s operation.
• Share account access, resell content, scrape data, or use bots without written authorization.
• Post misleading information about qualifications, services, or pricing.
• Engage in harassment, discrimination, abuse, or any conduct that harms other users or the Mujtahid community.

Mujtahid may monitor usage to ensure compliance and may remove content or restrict access when necessary.

4. Content and intellectual property

• Mujtahid content (logos, designs, UI, software) is protected by intellectual property laws; you may not copy, modify, or distribute it without permission.
• Instructors/Experts retain ownership of their original content but grant Mujtahid a worldwide, sublicensable license to host, display, deliver, market, and use such content to operate the Platform.
• Users may not share or reproduce purchased content outside Mujtahid except where explicitly permitted (e.g., downloadable materials for personal use).
• We may remove or disable access to content that we believe violates laws or policies.
• Users are responsible for obtaining necessary rights and consents for any third-party content they upload or share.

5. Bookstore, marketplace, and services

• Listings for new or used books, live courses, recorded courses, consultations, or services must be accurate, lawful, and comply with Mujtahid’s publishing guides.
• Service Providers are responsible for fulfilling deliverables, meeting deadlines, and ensuring quality standards; failure may result in refunds, disputes, or account sanctions.
• Learners must review product descriptions carefully and follow usage instructions or platform policies.
• For mediated services (large service requests, consultations), Mujtahid may appoint facilitators or mediators to monitor progress; their decisions on disputes are final unless overridden by law.

6. Payments, subscription, and wallet

• Prices are displayed in the applicable currency and may include taxes or fees where required.
• Payments are processed through authorized providers. You agree to provide valid payment information and authorize charges for orders.
• Refunds follow the posted refund policy for each product or service. Certain digital goods may be non-refundable once accessed.
• The Mujtahid wallet stores credits, earnings, or refunds; balances may be withdrawn subject to verification, minimum thresholds, and compliance checks.
• Any commission or revenue share due to Mujtahid will be deducted automatically unless otherwise agreed in writing.

7. Ratings, reviews, and communications

• Users may provide feedback or ratings; you must ensure they are honest, relevant, and respectful.
• Mujtahid may publish, moderate, or remove reviews that violate policies (spam, offensive, misleading).
• You consent to receiving transactional communications (in-app alerts, SMS, email) related to your account or services.
• Marketing communications require consent, which can be withdrawn via account settings or unsubscribe links.

8. Dispute resolution

• We encourage parties to resolve disputes amicably through the Platform’s support tools or mediation features.
• Mujtahid may review evidence and issue resolutions (including refunds, partial payouts, or account sanctions) at its discretion.
• Unresolved disputes may be referred to arbitration or competent courts in Riyadh, Kingdom of Saudi Arabia, unless required otherwise by governing law.

9. Suspension or termination

Mujtahid may suspend or terminate access, remove content, or disable services if we detect policy violations, fraud, security threats, legal obligations, or prolonged inactivity. Users may request account closure; residual obligations (payments, disputes) remain enforceable.

10. Disclaimers and limitation of liability

• The Platform is provided “as is” without warranties of merchantability, fitness, accuracy, or availability.
• Mujtahid does not guarantee specific outcomes; instructors and private tutors are independent providers unless explicitly stated.
• To the fullest extent permitted by law, Mujtahid is not liable for indirect, incidental, consequential, or punitive damages arising from use of the Platform.
• Total liability for any claim is limited to the amount paid to Mujtahid for the applicable service in the preceding six months.

11. Indemnification

You agree to indemnify and hold harmless Mujtahid, its affiliates, officers, employees, and partners from claims or losses arising from your breach of these Terms, violation of rights, or misuse of the Platform.

12. Changes to the Terms

Mujtahid may update these Terms to reflect changes in services, laws, or business practices. We will notify users of material changes via email or in-product notices. Continued use after the effective date constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Riyadh, unless mandatory law provides otherwise.
